As a condition of your use of the “WN”’s website, you warrant to “WN” that you will not use “WN”’s website for any purpose that is unlawful or prohibited by these terms, conditions, and notices. You may not use the Worldlink-Now.com and other related domains’ website in any manner which could damage, disable, overburden, or impair the “WN”’s website or interfere with any other party's use and enjoyment of the “WN”’s website. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the “WN”’s websites.
Your also agree that you will not participate in any form of business corruption, which is a felony punishable in the USA by up to 24 months imprisonment or up to a 10 million dollar fine. These laws were created to fight terrorism and other forms of organized crime and have variations around the world. A business corruption occurs in the form of a perpetrator and a recipient, which as per USA law hold both parties with equal guilt. The perpetrator’s motive can be, by law, an act of jealousy (i.e. as these laws were put in place to fight terrorism) and will cause a recipient to sway by means such as giving favors, money, etc. Business corruption is known all over the world in various capacities and if there is a “recipient” it is important to not listen to what the perpetrator has to say (i.e. “war on terror” is “war on jealousy” is not listen to what they say). The “recipient” should make it known to “WN” when this is happening so that all proper steps can be pursued. The “recipient” should not actually follow the directions of the perpetrator as this would constitute a felony as described above. There is no person or entity in the world that has the authority to do this, and the “recipient” before they become one, might be misadvised by the perpetrator in an attempt to cause the “recipient” to sway from the normal course of operations, services, employment, etc. By USA law, any agreement made by the perpetrator and the recipient for favors, money, etc to corrupt anybody’s business is null and void automatically. Worldlink-Now is a USA based company and any attempts to corrupt this company’s business and/or the “WN” website (including any and all related domains) is punishable under USA law. You also agree to hold harmless any affiliates, business listings, and all other related content and material printed on the “WN” website, including free from you/anyone who uses, visits, or has any connection with the “WN” website as being a perpetrator or recipient contributing to business corruption. This website is aiming to be the world’s largest and stands to help millions across the world by the services it is and in the future will provide by doing things, with enough acquisition of business listings, in a manner that no other website has ever done before in the world.

Dispute Resolution By Binding Arbitration (except EXCEPTIONS): PLEASE READ THIS SECTION CAREFULLY AS IT AFFECTS YOUR RIGHTS.
Most customer concerns can be resolved to the customer's satisfaction by emailing worldlinknow@gmail.com. In the unlikely event that “WN” is unable to resolve a complaint you may have (or if “WN” has not been able to resolve a dispute it has with you after attempting to do so informally), we each agree to resolve those disputes through binding arbitration, mediation, or small claims court instead of in courts of general jurisdiction. Arbitration, which is often cheaper, faster, and less formal than a lawsuit in a court, uses a neutral arbitrator instead of a judge or jury. Arbitrators can award the same damages and relief that a court can award. Any arbitration under this Agreement will take place on an individual basis; class arbitrations and class actions are not permitted.
Arbitration Agreement
WN and you agree to arbitrate all disputes and claims between us, except EXCEPTIONS which you agree gives both “WN” and you different rights. This agreement to arbitrate is intended to be broadly interpreted. It includes, but is not limited to:
- claims arising out of or relating to any aspect of the relationship between us, whether based in contract, tort, statute, fraud, misrepresentation or any other legal theory; except EXCEPTIONS
- claims that arose before this or any prior agreement (including, but not limited to, claims relating to advertising;
- claims that are currently the subject of purported class action litigation in which you are not a member of a certified class; and
- claims that may arise after the termination of this Agreement.

- EXCEPTIONS: You agree that any criminal acts that constitute a felony based on USA law, such as business corruption of any part of the “WN” or it’s website and contents therein, my be tried, by option, under USA law should “WN” decide to pursue and includes a trial and right to have a jury. You, in exchange, have the right to do the same. You may have other options based on your country where you reside.
References to "WN", "you", and "us" include our respective subsidiaries, affiliates, agents, employees, predecessors in interest, successors, and assigns, as well as all authorized or unauthorized users or beneficiaries of services or devices under this or prior agreements between us. Notwithstanding the foregoing, either party may bring an individual action in small claims court. This arbitration agreement does not preclude you from bringing issues to the attention of federal, state, or local agencies, including, for example, the Federal Communications Commission. Such agencies can, if the law allows, seek relief against us on your behalf. You agree that, by entering into this Agreement, you and WN are each waiving the right to a trial by jury (except EXCEPTIONS) or to participate in a class action of any kind. This agreement evidences a transaction in the interstate commerce, and thus the Federal Arbitration Act governs the interpretation and enforcement of this provision. This arbitration provision shall survive termination of this Agreement.
A party who intends to seek arbitration must first send to the other, by certified mail, a written Notice of Dispute ("Notice"). The Notice to WN should be addressed to Zia Barkatullah, Atn: Worldlink-Now, 135 Green Forest Dr. Clinton, MS 39056 USA ("Notice Address"). The Notice must (a) describe the nature and basis of the claim or dispute; and (b) set forth the specific relief sought ("Demand"). If “WN” and you do not reach an agreement to resolve the claim within sixty (60) calendar days after the Notice is received, you or WN may commence an arbitration proceeding. During the arbitration, the amount of any settlement offer made by WN or you shall not be disclosed to the arbitrator until after the arbitrator determines the amount, if any, to which you or WN is entitled.
The arbitration will be governed by the Commercial Arbitration Rules and the Supplementary Procedures for Consumer Related Disputes (collectively, "AAA Rules") of the American Arbitration Association ("AAA"), as modified by this Agreement, and will be administered by the AAA. The AAA Rules are available online at adr.org, by calling the AAA at 1-800-778-7879, or by writing to the Notice Address. The arbitrator is bound by the terms of this Agreement. All issues are for the arbitrator to decide, except that issues relating to the scope and enforceability of the arbitration provision are for the court to decide. Unless “WN” and you agree otherwise, any arbitration hearings will take place in Jackson, MS USA. If your claim is for $10,000 or less, we agree that you may choose whether the arbitration will be conducted solely on the basis of documents submitted to the arbitrator, through a telephonic hearing, or by an in-person hearing as established by the AAA Rules. If your claim exceeds $10,000, the right to a hearing will be determined by the AAA Rules. Regardless of the manner in which the arbitration is conducted, the arbitrator shall issue a reasoned written decision sufficient to explain the essential findings and conclusions on which the award is based. “WN” will pay all AAA filing, administration, and arbitrator fees for any arbitration initiated in accordance with the AAA Rules. In addition, if you initiate an arbitration in which you seek more than $75,000 in damages, the payment of these fees will be governed by the AAA rules.
The arbitrator may make rulings and resolve disputes as to the payment and reimbursement of fees and expenses at any time during the proceeding and upon request from either party made within 14 days of the arbitrator's ruling on the merits.
The arbitrator may award declaratory or injunctive relief only in favor of the individual party seeking relief and only to the extent necessary to provide relief warranted by that party's individual claim. YOU AND “WN” AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Further, unless both you and “WN” agree otherwise, the arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding. If this specific provision is found to be unenforceable, then the entirety of this arbitration provision shall be null and void.
Notwithstanding any provision in this Agreement to the contrary, we agree that if “WN” makes any future change to this arbitration provision (other than a change to the Notice Address) during your Membership, you may reject any such change by sending us written notice within 30 days of the change to the Arbitration Notice Address provided above. By rejecting any future change, you are agreeing that you will arbitrate any dispute between us in accordance with the language of this provision. |

Termination/access restriction
”WN” reserves the right, in its sole discretion, to terminate your access to the “WN” website and the related services or any portion thereof at any time, without notice.
GENERAL
You agree that no joint venture, partnership, employment, or agency relationship exists between you and “WN” as a result of this agreement or use of the “WN”’s website. WN's performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of “WN”'s right to comply with governmental, court and law enforcement requests or requirements relating to your use of the “WN”’s website or information provided to or gathered by “WN” with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.
Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and “WN” with respect to “WN”’s website and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and “WN” with respect to the “WN”’s website. You may not assign or otherwise transfer the Terms and Conditions, or any right granted hereunder, without “WN”'s written consent. “WN”'s rights under the Terms and Conditions are freely transferable by “WN”. Any failure by “WN” to enforce or exercise any provision of the Terms and Conditions, or any related right, shall not constitute a waiver of that provision or right. Any rights not expressly granted herein are reserved.
”WN” may provide you with notices, including those regarding changes to the Terms and Conditions, by email, regular mail, postings on “WN”’s website, or other reasonable means now known or hereafter developed.
A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent an d subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish of the parties that this agreement and all related documents have been drawn up in English. |
